Terms of service
This is an English translation. If there is any difference, the Polish version prevails, without limiting any consumer rights that cannot be excluded under the law of your country.
1. Service provider
Services are provided by Bartosz Domański, a sole trader trading as Honeyue, ul. Panewnicka 355, unit 6, 40-773 Katowice, Poland, NIP 6342967760, REGON 384524725, registered in CEIDG. Contact: [email protected] (Mon–Fri 9:00–17:00).
2. Definitions
- Provider — Bartosz Domański.
- Client — a natural person, legal person or organisation ordering a service.
- Consumer — a Client who is a natural person entering into an agreement for purposes not directly related to their business or profession. Consumer provisions also apply to a sole trader for whom the agreement is not of a professional nature (Art. 3855 of the Polish Civil Code).
- Services — running advertising campaigns, preparing creatives (graphics, copy, video) and outdoor advertising designs.
- Plan — a document sent by email setting out the scope of Services, goals, schedule, price and currency.
- Package — Services provided once for a fixed price; Ongoing management — Services provided in monthly cycles.
- Ad budget — amounts the Client pays the advertising platforms for ad delivery.
3. Website and form
The website honeyue.com presents the Provider's services and lets you send a brief. The website is not an online shop — there is no basket and no payment on it. Online payments are made only through a secure link from the payment provider Stripe (section 5). The brief form is a free electronic service; it requires a browser with JavaScript and an email app. The form prepares an email that you send yourself. Sending unlawful content is prohibited.
4. Plan, quote and conclusion of the agreement
Based on the brief and a call, the Provider sends a free Plan, valid for 14 days. The agreement is concluded when the Client approves the Plan (for example, by replying by email). The Provider confirms the agreement on a durable medium (by email).
5. Prices and payments
Prices on the Pricing page are shown in Polish złoty (PLN), British pounds (GBP) and US dollars (USD). The amount in the currency stated in the Plan is binding. Prices are final — the Provider is exempt from VAT under Art. 113(1) of the Polish VAT Act.
Packages and creatives are paid once, after the Plan is approved and before work starts. Ongoing management is paid monthly in advance. Payment methods: online payment through a secure Stripe link (Visa or Mastercard, Apple Pay, Google Pay, BLIK), including recurring card payment for Ongoing management, and bank transfer. Online payments are processed by Stripe Payments Europe, Limited, 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, D02 H210, Ireland. The Provider has no access to full card details. Payments appear on statements as HONEYUE. Details: Payments, refunds and cancellation.
6. Ad budget and ad accounts
Campaigns run on the Client's ad accounts (Meta, Google, TikTok), to which the Client grants the Provider partner access. The Client pays the Ad budget directly to the platform, under its terms; the Provider does not collect it or act as an intermediary in its settlement. The Client may remove access at any time. The Provider is not responsible for decisions of the advertising platforms, including ad rejection, account limitation or suspension, unless caused by the Provider acting against the platform's policies.
7. Materials and content
The Client provides the information, materials (photos, logos, texts) and data needed for the campaign and confirms they hold the rights to them. The Client is responsible for the accuracy of information about their offer. The Provider does not run campaigns in the categories listed on the Services page and may refuse to prepare an ad that breaks the law or platform policies — in that case it refunds the amount paid for the part of the Services not performed. Every creative includes two rounds of revisions; further rounds are quoted in advance.
8. Performance and results
The Provider performs the Services with due care, following the approved Plan and schedule, and sends a report after each month of a campaign. The Service is an obligation of diligent effort: the Provider does not guarantee any particular number of impressions, clicks, customers or sales, as these also depend on platform algorithms, budget, the offer and the market. The indicators in the Plan are used to evaluate and optimise the campaign. The Provider may subcontract parts of the work (such as photography or editing) to trusted collaborators and is responsible for them as for its own actions.
9. Copyright
Upon payment for a Service, the Provider transfers to the Client the economic copyright in the creatives prepared, in the following fields of use: recording and reproduction by any technique, storing in computer memory, making available to the public on the internet, publishing on social media and search engines, printing and display in outdoor advertising, together with the right to authorise derivative works. Stock photos, fonts and licensed music are provided under their own licences. The Provider may show the creatives in its portfolio unless the Client objects.
10. Cancellation and refunds
The Client may cancel a Package free of charge before work starts; while creatives are being prepared — with a refund of the amount minus the proportional value of work done; after the campaign goes live, it may be paused, and the Package fee is not refundable unless the Provider failed to do the agreed work. Ongoing management may be cancelled at any time, effective at the end of the paid month, at no cost. Refunds are made within 14 days, in the payment currency and using the same payment method the Client used, unless the Client agrees to another method at no cost to them. Before disputing a payment with a bank (chargeback), please contact the Provider — this does not limit the Client's rights.
11. Right of withdrawal
A Consumer may withdraw from a distance agreement within 14 days of concluding it without giving a reason, as described on the Right of withdrawal page.
12. Complaints
Complaints can be made as described on the Complaints page. The Provider replies within 14 days.
13. Liability
Towards Consumers, the Provider is liable under the Polish Civil Code and the Consumer Rights Act. Towards Clients who are not Consumers, the Provider's liability is limited to the fees paid for the Services in the period the damage relates to, and no more than for the last 3 months, except for damage caused intentionally; the Provider is not liable to them for lost profits or for Ad budget spend. This section does not limit Consumer rights.
14. Personal data
The Provider is the controller of Clients' personal data — see the Privacy policy. Where, as part of a campaign, the Provider processes personal data of the Client's customers (for example, lists for custom audiences), it does so only on the Client's instructions, under a data processing agreement.
15. Out-of-court dispute resolution
A Consumer may use out-of-court complaint and redress procedures, described on the Complaints page. Using them is voluntary.
16. Final provisions
These Terms apply from 13 May 2026. They do not exclude or limit Consumer rights under mandatory law. Polish law applies to matters not covered here. The Provider may change these Terms for valid reasons, informing Clients using Ongoing management at least 14 days in advance; they may then cancel at no cost. Agreements concluded before a change are governed by the Terms in force on the day they were concluded.
